Terms of Service

By accessing or using ShopifyGenie ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and ShopifyGenie ("we," "us," or "our").

If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" refers to that entity.

ShopifyGenie is an AI-powered analytics platform designed exclusively for Shopify merchants. The Service provides natural-language querying of your Shopify store data, including sales analysis, customer insights, inventory intelligence, product performance metrics, and discount analysis.

The Service connects to your Shopify store via Shopify's official API using read-only permissions. We do not modify, delete, or create any data within your Shopify store. All analytics are derived from data you have authorized us to access.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable.

To access the Service, you must create an account and connect your Shopify store. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Ensuring your account information is accurate and up to date.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period, with prior notice where feasible.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to violate any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use automated means to access the Service beyond normal usage patterns.
• Share your account credentials with third parties not authorized to access your data.
• Use the Service to infringe on the intellectual property rights of others.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure.

We reserve the right to investigate and take appropriate action against violations, including suspending or terminating access.

The Service, including all software, algorithms, designs, text, graphics, and other content created by ShopifyGenie, is owned by ShopifyGenie and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all data from your Shopify store. By using the Service, you grant us a limited, non-exclusive license to access and process your store data solely to provide the Service.

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation to you.

To the maximum extent permitted by applicable law, ShopifyGenie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total cumulative liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analytics outputs will be accurate or complete.

You may terminate your account at any time by contacting us at support@shopifygenie.ai or through your account settings. Upon termination, your access to the Service will cease and we will delete your account data in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service immediately, without prior notice, if we determine that you have violated these Terms, if required by law, or if continuing to provide the Service would expose us or others to legal liability.

Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ShopifyGenie operates, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

You agree that any claim arising from your use of the Service must be brought within one (1) year of the date the claim arose, or such claim shall be permanently barred.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service before the changes take effect.
